The terms “we,” “us,” and “our” refer to Hatinyi Atelier. Hatinyi Atelier operates this website and online store and offers handcrafted products, content, features, and related services (collectively, the “Services”).
Our store is powered by Shopify, which provides the e-commerce platform that enables us to offer our products and Services to you.
These Terms of Service (“Terms”) describe your rights and responsibilities when accessing our website, purchasing our products, submitting content, or otherwise using our Services.
By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Services.
Nothing in these Terms is intended to exclude, restrict, or waive any consumer rights or remedies that cannot legally be excluded under applicable law.
SECTION 1 — ELIGIBILITY AND ACCOUNT INFORMATION
By using the Services, you represent that you are at least the age of majority in your province, state, or country of residence, or that you have the permission of a parent or legal guardian where required.
When placing an order or creating an account, you agree to provide accurate, current, and complete information.
You are responsible for maintaining the confidentiality and security of your account credentials and for activity conducted through your account.
You may not impersonate another person or provide false or misleading information.
SECTION 2 — OUR PRODUCTS AND HANDCRAFTED NATURE
Hatinyi Atelier creates handcrafted and artisan products, including leather journals and other creative pieces.
Because many of our products are handmade and because leather is a natural material, slight variations may occur in:
- colour
- tone
- grain
- texture
- markings
- finish
- dimensions
- stitching
- placement of patterns or details
These natural and handmade variations are part of the individual character of each piece and are not necessarily considered defects.
We make reasonable efforts to display product colours and details accurately. However, colours may appear differently depending on your device, screen settings, lighting, or photography.
Product descriptions, designs, materials, and availability may be updated or changed without notice.
We reserve the right to discontinue products or limit quantities where reasonably necessary.
SECTION 3 — MADE-TO-ORDER AND PERSONALIZED PRODUCTS
Certain Hatinyi Atelier pieces may be handmade, made-to-order, customized, or personalized.
Processing and creation times displayed on our website are estimates unless expressly stated otherwise.
By purchasing a personalized or custom product, you are responsible for reviewing all names, initials, wording, colours, and customization details before submitting your order.
Hatinyi Atelier is not responsible for errors contained in customization information submitted by the customer.
Once work has begun on a made-to-order, personalized, or custom piece, cancellation or modification may not be possible, subject always to rights available to you under applicable consumer law.
Personalized and custom products may be subject to different return or exchange conditions as described in our Refund Policy.
SECTION 4 — ORDERS
Submitting an order constitutes an offer to purchase products from Hatinyi Atelier.
We reserve the right to accept or decline an order where permitted by law, including in cases involving:
- suspected fraud
- payment issues
- pricing or listing errors
- product unavailability
- suspected resale activity
- shipping restrictions
- inability to fulfil a customization request
Your order is accepted when we confirm acceptance or begin processing or creating your order, as applicable.
Please carefully review your order before submitting it.
If you need to request a change or cancellation, contact us as soon as possible at hatinyiatelier@gmail.com.
We cannot guarantee that changes or cancellations can be accommodated after production or order processing has begun.
SECTION 5 — PRICES, CURRENCY, TAXES AND PAYMENT
Prices are displayed in the currency selected or displayed on our website.
Currency conversions displayed to international customers may be calculated through our e-commerce or payment providers and may vary based on exchange rates.
Prices may change without notice.
The price applicable to your purchase will generally be the price displayed at the time your order is placed, subject to correction of genuine pricing or technical errors and applicable law.
Applicable taxes, shipping charges, duties, or other charges may be displayed at checkout where available.
You agree to provide accurate and authorized payment information.
We reserve the right to cancel or decline transactions that we reasonably believe are fraudulent or unauthorized.
SECTION 6 — INTERNATIONAL SHIPPING
Hatinyi Atelier is based in Ontario, Canada and may ship to selected destinations worldwide.
The availability of shipping to a country or region may change at any time due to carrier availability, legal restrictions, customs requirements, service interruptions, or other circumstances.
Shipping and delivery dates are estimates and are not guaranteed unless expressly stated otherwise.
International shipments may experience delays due to:
- customs processing
- border inspections
- local postal services
- carrier disruptions
- weather
- holidays
- incorrect or incomplete addresses
- events outside our reasonable control
Hatinyi Atelier is not responsible for carrier or customs delays outside our reasonable control.
However, nothing in this section limits any rights or remedies available to a customer under applicable consumer law.
SECTION 7 — CUSTOMS, DUTIES AND IMPORT TAXES
International orders may be subject to customs duties, import taxes, tariffs, brokerage fees, or other charges imposed by the destination country or relevant authority.
Where duties and import taxes are collected at checkout, this will generally be displayed during checkout.
Where duties, taxes, or import charges are not collected at checkout, the recipient may be responsible for paying charges imposed by the destination country, carrier, or customs authority.
Hatinyi Atelier does not control charges imposed by foreign customs or tax authorities.
Customers are responsible for familiarizing themselves with import requirements applicable in their destination country.
We will not intentionally falsify customs declarations or declare an inaccurate product value.
This wording is important because Shopify supports collecting duties/import taxes at checkout in eligible setups, while international customers may otherwise face charges when receiving a shipment.
SECTION 8 — SHIPPING ADDRESSES
Customers are responsible for providing a complete and accurate shipping address.
Please contact us immediately if you notice an address error.
We cannot guarantee that an address can be changed once an order has been processed or transferred to a shipping carrier.
If an order is returned because of an incorrect or incomplete customer-provided address, additional shipping charges may apply before the order can be resent, to the extent permitted by law.
SECTION 9 — REFUSED, UNCLAIMED AND RETURNED INTERNATIONAL PACKAGES
Customers are responsible for monitoring tracking information and complying with reasonable delivery or customs requirements.
If a parcel is refused, left unclaimed, or returned to Hatinyi Atelier due to the customer’s failure to pay applicable charges that were clearly disclosed as the customer’s responsibility, additional shipping or return costs may apply.
Any refund or reshipment will be handled in accordance with our Refund Policy and applicable law.
Original or return shipping costs may be deducted from an otherwise applicable refund where legally permitted.
SECTION 10 — LOST OR DAMAGED ORDERS
If your order arrives damaged, please contact us as soon as reasonably possible at hatinyiatelier@gmail.com.
Please include:
- your order number
- a description of the issue
- clear photographs of the product
- photographs of the packaging where relevant
We may require this information to assess the issue or submit a carrier claim.
If tracking indicates delivery but you cannot locate your parcel, please contact us so we can review the available shipping information.
Our handling of lost, damaged, or missing orders is subject to our Shipping Policy, Refund Policy, and applicable consumer law.
SECTION 11 — RETURNS, REFUNDS AND EXCHANGES
Returns, refunds, cancellations, and exchanges are governed by our Refund Policy.
Certain custom or personalized products may not be eligible for change-of-mind returns where permitted by applicable law.
Nothing in our Refund Policy or these Terms limits statutory rights or remedies that cannot legally be excluded.
SECTION 12 — INTELLECTUAL PROPERTY
Unless otherwise stated, the Hatinyi Atelier website and its original content, including our:
- brand name
- logos
- product designs
- original photographs
- graphics
- written content
- videos
- collection concepts
- website design elements
are owned by or licensed to Hatinyi Atelier and are protected by applicable intellectual property laws.
You may use our website for personal, non-commercial purposes.
You may not reproduce, copy, distribute, commercially exploit, or falsely claim ownership of Hatinyi Atelier’s protected content without permission.
Nothing in these Terms grants ownership of Hatinyi Atelier intellectual property to you.
SECTION 13 — COMMUNITY SUBMISSIONS AND “FROM YOUR PAGES”
Hatinyi Atelier may invite members of our community to submit journal entries, poems, stories, photographs, artwork, reflections, or other creative content (“Community Submissions”).
You retain ownership of the original content you submit.
By submitting content for consideration and granting us permission to feature it, you grant Hatinyi Atelier a non-exclusive, worldwide, royalty-free license to reproduce, display, publish, format, and share the submitted content through Hatinyi Atelier’s website, social media channels, emails, and brand-related promotional materials.
We will not claim authorship of your original creative work.
Where appropriate and where you provide a preferred name or attribution, we may credit you as the creator.
You represent that:
- you created the submitted content or have permission to submit it;
- your submission does not infringe another person’s copyright, privacy, or other rights;
- you have permission from identifiable individuals shown in submitted photographs where required; and
- your submission does not contain unlawful, threatening, hateful, defamatory, or intentionally harmful content.
Submission does not guarantee publication.
Hatinyi Atelier may choose whether to publish, feature, edit for formatting, or remove a Community Submission.
We will not materially alter the meaning of a poem, story, journal entry, or other written creative work without the creator’s permission.
If you wish to request removal of a published Community Submission, contact hatinyiatelier@gmail.com. We will reasonably review removal requests, although previously distributed or archived materials may not always be capable of immediate or complete removal.
Hannah, I specifically changed this from Shopify’s aggressive “perpetual commercial Feedback licence.” For your poems/journaling community idea, I think telling creators they retain ownership is MUCH more aligned with Hatinyi.
SECTION 14 — REVIEWS AND FEEDBACK
Product reviews, suggestions, and general feedback submitted to Hatinyi Atelier may be used to operate, improve, and promote our Services.
You represent that content you submit is truthful to the best of your knowledge and does not violate the rights of another person.
We may remove content that is unlawful, fraudulent, abusive, obscene, or infringes third-party rights.
We will not knowingly present materially altered customer feedback as an authentic customer statement.
SECTION 15 — THIRD-PARTY SERVICES AND LINKS
Our Services may include tools, applications, payment services, shipping services, or links operated by third parties.
Your use of third-party services may also be subject to the relevant provider’s terms and privacy practices.
Hatinyi Atelier is not responsible for third-party websites or services outside our reasonable control.
Please review the applicable third-party terms before using their services.
SECTION 16 — RELATIONSHIP WITH SHOPIFY
Hatinyi Atelier is powered by Shopify, which enables us to provide our online store and Services.
Purchases made from Hatinyi Atelier are transactions between you and Hatinyi Atelier.
Shopify provides e-commerce infrastructure and is not the seller of Hatinyi Atelier products.
Your use of certain Shopify-powered features may also involve processing of information by Shopify as described in applicable privacy notices.
SECTION 17 — PRIVACY
Our collection and use of personal information is described in our Privacy Policy.
Because our store is powered by Shopify, certain personal information may be processed by Shopify and other service providers to operate our store, process transactions, prevent fraud, and provide related services.

You may not use our Services:

Occasionally, information on our website may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, availability, promotions, shipping, or processing times.
We reserve the right to correct genuine errors and update information.
Where an error affects an order you have placed, we will handle the matter in accordance with applicable law and may contact you regarding available options.

To the extent permitted by applicable law, the Services are provided on an “as available” basis.
We do not guarantee that the website will always be uninterrupted, secure, or error-free.
Nothing in these Terms excludes warranties, guarantees, conditions, rights, or remedies that cannot legally be excluded under applicable consumer law.

The remaining provisions will continue in effect.

Subject to mandatory consumer protection laws and any rights you may have under the laws applicable to you, disputes relating to these Terms or the Services will be subject to the jurisdiction of the courts of Ontario, Canada.
Nothing in this section is intended to deprive a consumer of mandatory rights or protections that apply under applicable law.
